dear friends,

I am on H1B. my wife is on H4. I want to apply ITIN no for my wife.

Q1. should i file under "Spouse of U.S. citizen/resident alien" or "Dependent/spouse of a nonresident alien holding a U.S. visa".

Q2. what are the documents I need to submit with the W-7 form.

Q3. is ITIN application only possible during tax return filing or I can apply and get the ITIN number early and then use it during my tax filing.

Q4. How much is the fee for the ITIN no.

Can the lawyer ask for the missing form; and will it have to be done by the USCIS at the I-140 stage? I was under the impression that only the USCIS can do this?

I think these days especially (Nebraska service center) is looking for every possible to give RFE. RFE Looks like not complicated but you need to explain in detail every item.

Hi,

I recently traveled to Canada by land for 1 week . When I went to Canada the canadian authorities did not take my I 94. When I returned from canada, the US officials did not give me a new I 94, will this be a problem ?

If the travel is less then 30 days to Canada or Mexico you do not need Visa Stamping also. It is called Automatic Visa Revalidation.

I don't think that's possible. USCIS wants a physical address where you stay and will not deliver mail to PO box. In fact there is no forwarding of documents sent by USCIS too. They are all returned to USCIS.
This issue I think originates from the fact that USCIS wants to know where all aliens are physically staying.
I wanted to have a PO box to avoid any issues with mail theft and my lawyer said its not possible.
Anything different coming from your lawyer would be welcome.

Lawyer also has given whatever your lawyer said.
However, I know of few cases where people received green cards at their po boxes. If you call up custmer service, they will be happy to change the I-485 addresses to po box addresses.

A friend's H1B transfer from company A to company B was denied. Since his H1B with company A is still valid and is going to expire in 3 months, he can still go back to work for company A. However, if he chooses not to work for company A and tries to find a third employer to do another transfer, is he considered out of status for these three months?
Do you know as to why it got denied ?

Hello,
My wife and I have a pending AOS, and have our EADs.
My priority date for EB-2 is September 2004.

I plan to go back to school in Spain - starting November 2009. The program ends in December 2010. However, my EAD expires October 2010.

Is there anything I can do to keep my GC processing on track? Can I renew my EAD while I'm in Spain?
