We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
Check your I-797 - receipt notice for your I-485. In that there is a received date. That is your RD. There is another field, notice date or ND that might change depending on the transfer. If the RD is different from July 2nd, you can talk to the customer service and try to get it corrected.
BTW, though they have to process in the order of RD, I don't think they are following it. From reading here and other forums, I think they are following the ND.

I had to go through the same process last year. The day i went for the interview, there were 3 other PhDs with me to get their H1B stamped. It took me 7 weeks to get the passport back and for others it took longer. Calling embassy will not expedite the process. Call Department of State and ask for the update. I know its frustrating.

Travelling via UK is OK as long as you have GC or a valid US Visa stamped in the passport. Even if flights are delayed, staying at the airport is no problem. The problem is not in UK but at the time of boarding in home country. Once you are on the plane....you are fine.

You do not need EAD as your have GC. You can stay and work using your GC. EAD is required while your GC is under process.

Hi all,
I graduated this June and started working in a company on my OPT status (valid July 2009 to July 2010) since July until now. In October, my company filed H-1B petition, and on Nov 24, we got approval notice I-797B (without I-94) instead of I-797A, as well as a DENIAL of concurrent change of status.
Shortly after we filed the petition, I took a short trip to my home country and then come back(with OPT status) on Nov 1.
In the notice, it states "...the beneficiary departed the US on Oct. 15 2009, thereby abandoning the requested change of status. As such, the beneficiary has failed to maintain his F-1 status. Accordingly, the concurrent request for change of nonimmigrant status is denied."
I am really confused here because I re-entered the US with my F-1 OPT status on Nov. 1 without any issue.
What should I do now in order to get my H-1B visa? Am I still maintaining F-1 status (legally staying in the US) even if it stated that I have failed to??

My EAD, AP and II140 are all approved because of the July Fiasco and its been more than 180 days since they all got approved.
I have my EAD and AP in hand, but I140 is with employer. I neither have a copy of it, nor the receipt number/tracking for it . All I know is that it is approved. My employer will not give it to me as it is not required by law. I am still working on H1 (haven't used EAD yet)
Recently the client I am working with asked if I would be interested in a full time with them and said I can use my EAD. Is it possible for me to take up this offer without having any details about my I140 except knowing that it is approved.?
PS: I trust my employer. If they said my I140 is approved, then it is.
Safest thing to do: get a copy of I 140 approval and also copy of labor certification from USCIS via Freedom of Information act request (FOIA).
This way, you case will be clean (you need to use AC 21 and new job needs to be same or similar to the one for which you have GC filed; this requires a good attorney's help along with job titile and job description in original labor).

The continued renewal of the Coast Guard fleet and use of modern technology across the department is an indispensable part of our strategy to improve the ability of DHS to secure our nation and protect its citizens.

It is partly my fault as I should have noticed when I started a new project in end August in South Carolina.
But now looking at my W2 it shows that my employer has been filing taxes in my previous state Missouri for the entire year. How should I go about correcting this? I was in Missouri for 5 months and in South Carolina for the remainder. In which state should I file my tax too?
Any help will be greatly appreciated

Some employers who rarely hire professionals in need of H1b may not be aware of process and may ask you to look for lawyer to do it for them. The H1B petition is filed by employer. However, employee can certainly help with it. Legally, the employer cannot charge the employee for USCIS fees or lawyer's fees. However, you can hire your own lawyer to help you with your questions and answers(if you hire your own lawyer, you can be comfortable with all advise he gives you, since he would have your best interest in mind as you would be the client). However, to file a petition of H1, your employer should be paying the lawyer(either your lawyer or their lawyer).
Filing for H1B petition requires a fixed set of documents and its simple to do if you have time to do a little research. Many employees help their employers and together, they do it themselves without the help of lawyer, therby saving money. An average lawyer would charge 1000 dollars in fees for filing the petition. For USCIS fees, please look up their website.
There are H1 specific forums on www.immigrationportal.com which would have more details.

Issue is getting to Canada and staying there long enough with the high taxes they have average canadian tax burden is 40% (30% tax + 10% additional sales tax on everything you buy) !

I checked with my attorney, she there is possiblity of it getting approved but there is risk also.
In progressive experience I meet even the experience criteria if I include all my work experience prior to me passing the degree. could this work experience be used.

That is not entirely true. Websites like Indymedia are NOT the same as the Fox News Network. This organization is the new equivalent of MoveOn.org.
When I have taken the effort to tell people the real issues at hand with the legal immigration reform needed, they DO CARE.
Indymedia is effectively a news blog run by an organization with liberal, activiist sensibilities.
We must remain open minded and creative when thinking of other avenues to spread the word. A very quick look at the site and they show TREMENDOUS support for immigration rights.

As per my attorney, NO it won't affect the GC process. However the Job description should remain same as in your Labor Certificate.

My husband just had his performance appraisal today. He is presently working as a Senior Consultant.What we are wondering is that if there is any change in the designation, will it affect the GC process in any way ?
We got our I-140 last month and EAD two weeks back.

Canada has been using this for skilled worker program, where individuals can apply for Canadian permanent residency independently if they fullfill the passmark. Other countries like Australia, UK and New Zealand also follow suit with different types of difficulties.
