Today, our AP status has changed to "Document mailed to applicant". Does this mean that they have mailed the approval document or is it an RFE document?
For most of the applicants the status has turned to "Approval Notice sent" but mine is different. Is anyone in the same boat.

Question2) Does this H1B transfer go through the 65,000 quota system?? Is there a chance my H1B transfer can be rejected because I did not make it in the 65,000?

You can start working with Company B once you get the receipt of filing. There is no need for you to join company B even after they have filed for your transfer. - you can continue to work with company A.

It is unlikely that your husband will have a problem. As another poster said, he just needs to show that he is maintaining H-1B status. A very difficult CIS officer could take the view that he is not maintaining status if he is not being paid the prevailing wage. However, that is very unlikely. Underpaying an employee is an employer violation, not an employee violation.

I know this has been asked gazillion times but jsut wanted to make sure I got it right.
On uscis website for my I-485 it says " On June 9th we recieved you application and ........so forth.
The date when this is done is June 13th as seen on the LUD.
So my understanding is that my 6 months period for me to knick in the AC21 rule would be Dec'9th.
Is this correct ??

Is there premium processing for I-765 which is t get EAD through marriage.

You may expedite the EAD processing if you've a valid reason like financial loss or others.. Check with your lawyer for your specific case...

That remains to be seen. Congress cannot act in a mere speculation that there will be spierce competition between EU and US on skilled labor. US still attracts a lot of foreign skills. Increasing the number is not always seen as a solution but streamlining is or efficiency in adjudication is.
Anothe problem is that US thought it is adding more into the work force everyyear by giving out immigrant visas (EB). This is wrong because most of the applicants are already in the workforce under H1B and their dependents. What EB visas do was to retain these foreign skills by giving them permanent residence status. Therefore, EB visas are there not to add into the workforce but to maintain the current workforce.
The real visas for adding into the workforce is the H1B, which is temporary and only 65,000 per year which in a week time was used up.

" Labor Certification by ABC ABC, Inc. on your behalf has been submitted via the Department of Labor�s (DOL) Permanent Online System as of the above date (April 1) . The application will be adjudicated by a National PERM Processing Center. As the DOL does not currently have a processing schedule for PERM applications, we are unable to predict how long processing will take. In the past, PERM applications have been adjudicated anywhere from a few weeks to several months. Unfortunately, there is currently no way for beneficiaries to check the status of the application. We will contact you as soon as we hear anything specific regarding your case. "

Unless otherwise you invoke her H1, she will be in H4 even if H1 is approved today. Invoking means, going to home country and getting it stamped or start working for a company and getting paid via paystub and having SSN

Hello,
I was on valid 3-year H1 visa until Dec 2010. I got layed off in Feb 2009.
I found another employer to file my H1 transfer case in April '09 and the case is still pending (regular processing). We received a RFE asking for my most recent pay stubs and employer info recently.
The question I have is if the H1 transfer gets denied, what do I do next? How much time do I have to leave the US? Do they give time to pack and make plans to leave? I don't want to face deportation. Also, I have a valid 10- year B1/B2 visa stamped on my passport. Can I use that in any way.

Your status is governed by the last I-94 which I assume is based on the H1B visa. Once you have had the H1B stamped on the passport, the B1 would have become invalid at that point (even though you may not have the "cancelled without prejudice" stamp on it).
Now, if your H1B gets denied, God forbid, you have 10 days to leave.

1.He lost his and his wife's passport alongwith the receipt notices and FP notice.The current visa which has expired and I-94 is also lost.
2.The lost passport includes the old passport with old visa in it.
Can you please throw some light as to what are his options.

Did he filed a police complaint? If not, ask him to file a police complaint and then apply for a duplicate passport with a copy of old passport along with the copy of police complaint.
After getting the duplicate passport, (if he goes to his respective embassy, I think he may be able to get the duplicate in a day) ask him to call USCIS and talk to immigration officer. He also may need to contact his attorney who will provide a plan to obtain duplicate copies.
