Hi- My stamping on my passport expired on Sep'2008 (over 19 months now). But, my I-797 is valid till Aug'2012. I plan to get my visa re-stamping done when I go to India in May'10.
1. Will there be any issues?
2. What am I supposed to say for this question in the visa application website?
"Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*" (YES/NO)
The VFS website says the following:
"The following applicants do NOT qualify for appointments in the visa renewal category:
Applicants who have a U.S. visa that expired more than 12 months ago.
"

As for as the standard procedures concerned, you will have no issues. There are chances for 221g, definitely not because of you have let the visa stamp expired, but if they need to check about your company.

My wife was pregnant when we did the July 2007 485 filing and now is being asked for the TB Test. It says X ray is mandatory on the letter from USCIS. The Immi DOctor said its really not and really depends on the skin test - so he will write and take care of that in the letter.
Next thing is that I am not with the same employer who I was with when I filed 485 in July 2007. Thus dont have an attorney any more. Do I need to send the response with a G28 form with no Attorney representation from now on OR do I just reply with no G28 form to indicate I no longer have Legal representation?
Whats the right way of handling this?

The preadjucation process is just like bringing a pregnant woman into labor but not allowing her to give birth till the babies number comes . The woman then needs to be painful labor for 28 years ( some member said that’s how long it will take ) , so the baby is grown and healthy ( preadjucated according to USCIS ) , but the doctors from the Department of state ( DOS ) are not allowing the baby to come out into the world .
USCIC is off late preadjucating the petitions and keeping them ready and many members seem to thrive on just seeing and discussing the LUD dates since by now most of us know somewhere in the subconsious that the GC is a nothing but a bone tied to our tail which we might never be able to bite .
Some members including me who unfortunately lack the analytical skills of some looked into a very interesting thread some time back which said EB2 will be current within a year . It spoke about 'spillovers' and we all were very happy that finally our baby will see the light of the day . Just like hope never dies I even though the dates have moved back to a date when most of us were in graduate college and the Clinton administration just left , some members are still now hopeful of a "spillover".
I for one have done what it takes for 4 long years in all ways possible to wake these guys up and now I am honestly least bothered about my GC and I feel the earlier members get to this level of mindset it will give them a lot of mental peace . I am just waiting for my visa to expire or my wall street employer to lay me off( whichever happens earlier ) in which case I also get a free ticket home .
The expectation that "next month may be the month" will surely kill you long before your GC actually gets cleared ( after 28 years ) .

Anybody who had an I94 issued only till the validity of the visa and not until the I-797? At the POE the guy simply wouldn't understand when I tried to explain to him that I have an extension (797) valid from 4/10 t0 4/11. He gave me an I94 only until 4/10. I read that people go for deffered inspection and get it corrected. Anybody who did that in a similar situation active in IV now? Any suggestions on how to proceed? do you go to the nearest international airport or an off-airport location?
Its common for IOs at POE to do this. Their side of the explanation is that they cannot give you an I-94 based on a I-797 which will be valid in the future. They have to go with a currently valid document. Like others suggested, you will have to either re-enter US immediately after the current I-94 expires or go to the nearest intl airport and get this done by defferred inspection.

Hi,
I got appointment letter for Biometrics from USCIS. I already gave in 2007.
Why are they asking again? and I only got this, my husband and son didn't get it.
Right now I am on EAD, since last december(2009) I am not working, will there be any issues as I am the primary applicant.

A frequent question that arises is whether a foreign national living in the United States for a certain number of years can obtain permanent residency based on the years of living in the United States. I heard from one of my Frnds that all of their L1 visa extensions are getting rejected left and right....
Most of them are on these L1 Visas in managerial postions.

That applies for you primary I-485 applicant. For derrivative applicant your spouse, she can use EAD for any job description. It need not match her job description.
Me and my spouse both work on H1B and I am applying for I-485 along with EAD/AP for both me and my spouse. My question is since my spouse is already in H1B with certain job title which was mentioned in one of the documents that was filled with i-485, when spouse uses EAD does she need to be looking for similiar jobs only?. I anticipate an inevitable situation arising out regarding my parents' health, that would require us to move back to India sometime in 2007. My EB2 NIW PD is Dec 2004. Does somebody out there with knowledge about issues and procedures connected with transferring from AOS application to Consular processing in India?

You can change from AOS to Consular Processing. It's the other way around that's not possible. I wish your parents a speed recovery of their health.

I am working in US from Feb 2007 to till date. I was on H1-B visa This H1-B petition is valid till 30 sep,2009. I am currently on project which ends on 31 March 2009 . Before that I want to change my employer .
Some ppl suggested me Transfer H1 with extention immediately. Some said that stay with current employer have extention and then transfer . Is there any problem now a days for H1 Transfers ?
Please give me your valuable suggestions.

For your new employer to be able to file for H1, you need all your documentation current. You can apply for a new H1 through your new employer using Premium processing and its not subject to 2009 quota. You can start working on your new project with the employer as soon as you get the receipt. You might get an RFE for H1 transfer as to the availability of the position and if that position is in a TARP funded company or industry then its going to be a pretty difficult task to get approval for ur H1.
Ideally stay with your current employer and see if you can work it out so that you get a new project through your employer only.

thank you so much for the reassurance, have been getting mixed reports of immigration officers denying re-entry, so am a little perturbed :) dont want to be stuck in a situation where i cannot re-enter :)
