May be IV code is already aware and working on this. I think with the nuke deal out of the way, we now have a window of opportunity - may be Q1/Q2 2007 - during which we can try to get USINPAC, India caucus etc. to listen to us and hopefully actually do something.
Once the so called "123 agreement" is finalized and reaches congress for approval, we would again be shut out of any help from USINPAC and others.

A friend's H1B transfer from company A to company B was denied. Since his H1B with company A is still valid and is going to expire in 3 months, he can still go back to work for company A. However, if he chooses not to work for company A and tries to find a third employer to do another transfer, is he considered out of status for these three months?
Do you know as to why it got denied ?

I am in H1b and my wife is a F1 student. Both of us are chinese.
My company will apply the Green Card for me this year. As I know, my wife can be dependent on my application.
My wife always go back to china every summary or winter vocation. She need to re-apply her F1 visa every year as a student from china.
My concern stems from my wife's F1 status. We are wondering whether the immigrant petition will conflict with her F1's non-immigrant intention (unlike H1B which is accepted as a transient from non-immigrant to immigrant).
Will this conflict have a huge affection on her F1 visa application in china?

Hi Gurus i need your help, here is my situation :
Currently I am working for company B and have not started PERM process yet from this company. But i have an approved i 140 from company A and my lawyer is saying that i can go ahead and file 485 on the basis of approved I 140 from company A. Meanwhile he will start PERM from company B and he is saying that by the time USCIS open my application of 485 and create RFE I will have I 140 approved from company B and since it's the exact same job we will be able explain USCIS about the intent of filling.
Is it ok to go ahead and file 485 becoz i will not have the employer's letter from company A and also the paystub will be from company B and not A.
Am i heading towards trouble ??? please help GURU's

What's your PD? if it's around 2002/2003 - then you will become current after Oct anyway, so you can apply with "clean" 485. Then I wouldn't bother. If your PD is 2006/2007 - then it's worth trying, it may work. At the worst case 485 will be denied, you will then file another "clean" one in that case.

My H1 was expired last year with 6 years terms so I used my EAD since last year. Can I go back to H1B still because my i-485 is still pending for renewal another 3 years term? Which law is winning, 6 years H1B if did not continue renew my H1 or I-485 pending so I can continue renew? I have found different attorney have different answer.

your wife is fine, with H1 transfer there is no need to file H4 transfer. She is not out of status.
If she had presented the new H1 approval she would have got I-94 based on that date. So just apply for her H4 extension now.
And no issues with filing I-485

As we move closer to an Immigration reform, even government officials agree that such major change is very necessary. Here are some remarks by Secretary Napolitano on Immigration Reform at the Center for American Progress:
Over the past year, as this Administration has pursued more effective strategies within the current laws, the picture of how exactly those laws need to be changed has become clearer than ever before. In the past ten months, we have made tough choices, and implemented significant reforms within the current legal framework�but they are not enough to create the system that we want or that we need. If we are truly going to fix a broken system, Congress will have to act.When it comes to immigration, I took an oath as Secretary of Homeland Security to secure the nation by enforcing the law and managing legal flows across the border. Let me be clear: to do this job as effectively as possible, DHS needs immigration reform.Reform legislation would provide lasting and dedicated resources at our borders, and provide some critical legal tools that we don�t currently have to combat smuggling organizations. For example, we need tougher anti-smuggling laws in dealing with the aggravated crimes smugglers commit�including assaulting law enforcement officers, endangering children, threatening relatives and abandoning people in the desert� hundreds of whom succumb to death from heat and lack of water. We also need to update current laws that don�t cover some of the new means by which criminals conduct their business. For instance, today�s smugglers and drug traffickers often move cash through �stored value� cards, which aren�t even considered monetary instruments under the current money-smuggling laws.In addition, we need improvements to the current law when it comes to interior and worksite enforcement. Dishonest businesses often ignore the civil fines for illegal employment now on the books because they�re so low. I filed this week my N400 based on a 5 years rule;
I am a freelance book writer and a web market engeneer;
In 2005 I was let go from my job; I filed for unemployment and I traveld to Asia working part time as writer and looking for a new job and find new places to write about in my book;
the trip lasted 5 months,
I attached my taxes for the last 5 years to the application:
will CIS look at the taxes for 2005 and look at the unemployment benefits together with my international travel?
AM I in trouble when I show up for the interview? I am concerned
